I do believe that societal norms should play a role in what determines what is illegal and what is legal. I think a good example is how in 2008 when a case in California concluded that limiting same-sex marriages were unconstitutional, people still found issue with it and created Prop 8, which proposed a ban on gay marriage. A lot of people don’t know about this, but the majority of people voted yes on the ban so it reached the federal level, but was still ultimately decided that both Prop 8 and the ban of same-sex marriage violated the 14th amendment since it was violating the rights of an marginalized group of people. I believe this is a pretty good example for the role societal norms plays in our law making, that even though the majority of people in California had voted yes on Prop 8, it did not discredit the fact that the margin of people who voted no was very small and account for 48% of the vote.
Both common law and codified laws have their disadvantages and advantages, and their uses are situational. Codifying all laws can be inflexible since it is now following a code instead of adapting to certain situations, can be considered outdated in future time, and even more difficult to change. Something I consider dumb that is illegal in the US and that other countries practice, is the drinking age. I still understand the arguments against lowering the age to 19, I do believe that it can help with those who are susceptible to substance abuse and prevent drunk driving accidents among young people. Although in my experience, those who consume illegal substances will consume those illegal substances even if there is a law prohibiting it, if you look at the recent news you can see a 49 year old man crashed near Mariposa Rd., there’s also another incident where two drunk drivers had crashed into each other near Mojave Dr. Honestly, I think as long as someone is drinking in a place that is allowed and in a controlled manner, I see no issue with it. Although, vapes and smoking is another issue I have a problem with, and they should ban all vape commercials the same way they’ve banned it for cigarettes, it’s too addicting and harmful.
