You are the Human Resources Manager for Transparency University, a private not-for-profit [501(c)(3)] university located in Crockett, Texas that offers undergraduate and graduate degrees. The university has an enrollment of 7000 students and employs more than 600 people in faculty, administrative, and staff positions. You report directly to the President and are a member of the Executive Committee. Other members of that Committee include the Provost and VP of Academic Affairs, the VP of Finance and Administration, the VP of Information Technology, and the VP of Student Services. Recently, the President attended a seminar in which various parties presented on the advisability and necessity of microchipping students and employees at universities, including student-employees such as Teaching Assistants or Graduate Assistants. The President sees terrific efficiencies in the use of microchips. He would like to ask students and employees to voluntarily accept them in an inobtrusive area between their thumb and index fingers and he believes that the chips will be accepted gratefully, given all the plusses that go along with them. However, he wishes to ensure that if students or employees are not willing to accept the microchips, that they will be inserted involuntarily. He wishes to begin the process in the fall of next year. He recognizes that there are a bevy of issues related to this change. He would like you to advise him and the Executive Committee on how to put this change into effect, whether the students and employees agree to it or not. The Assignment: Prepare a business memo for the President and the Executive Committee that: 1. Provides a summary of legal and ethical issues that relate to the requirement for installing microchips in students and employees. 2. Provides an overview of any current state (Texas) and federal (both constitutional and statutory) laws that apply to requiring microchips in students and employees or in human beings in general. 3. Identifies which exemptions and accommodations might be considered by TU for those refusing to be microchipped. 4. Identifies existing forced or voluntary microchip school or work environments domestically or internationally and, if any exist, how the company or business or school complies with laws that apply. 5. Identifies at least 5 state and 5 federal agencies that would have authority in full or in part over the practice of microchipping (RFID Chips will be used, likely). 6. Analyzes the extent to which the university can implement a full microchip environment among students and employees, providing: a. 5 current equivalents of microchipping people b. 5 pros of microchipping c. 5 cons of microchipping d. The identity of 5 primary or secondary stakeholders 7. Identifies proposed changes in laws that can impact both the current and proposed plan and discuss the political process (parties, how new laws can pass, whether there are within the last 10 years proposals for microchipping laws and if those legislative proposals exist, where they stand currently). 8. Provides an 8-step implementation plan to the President on how to have the best chance to be legally allowed to require students and employees to be microchipped to attend TU, including the removal of chips on termination of employment or enrollment at TU. 9. Provides a recommendation on whether legal counsel should be consulted and why or why not. If your recommendation is “yes”, then provide 3 specific questions that should be asked of legal counsel and why. This memo must not exceed five pages single spaced.
